專利價值衡量指標之建構─以台灣侵權訴訟專利為例

A Study of the Indicator of Patent Value Based on Taiwan Litigation Patent

摘要


本研究目的在於深入探討台灣訴訟專利價值建構專利價值衡量之指標模型,從中找出適合衡量我國專利價值之指標,台灣專利資料庫並未建置引證資料,本研究未採納引證指標。最後將訴訟專利依據相似性質歸類出不同的群組,探究各群組專利之特性。研究樣本以台灣智慧財產法院在2008年1月1日至2014年12月31日之中,所產生1,476案專利訴訟案件,系爭專利為659筆,專利類型分別新型專利376筆、發明專利214筆、設計專利69筆。其中74筆勝訴專利,545筆敗訴專利,40筆進行訴訟中。根據文獻探討本研究採納五大專利指標為獨立項、範圍數、審查時間、專利家族、存活年進行集群分析。 研究結果顯示台灣訴訟專利新型專利多於發明專利及設計專利,國外來台訴訟以日本及美國為最多,其次為瑞士及中國。專利技術主要集中在生活(A)類、運輸(B)類及物理(G)類。勝訴專利在獨立項、範圍數、審查時間、專利家族、存活年等指標皆勝過敗訴專利。進一步將訴訟專利分為「全球布局型」、「在地多元型」、「區域布局型」,比較其差異發現「全球布局型」專利,在獨立項、審查時間、專利家族、存活年等指標皆優於其他兩群,僅在範圍數上與「區域布局型」沒有差異。足見獨立項、範圍數、審查時間、專利家族、存活年等指標可作為衡量台灣專利的指標。

The purpose of this study is to investigate patent value of the litigated patent in Taiwan by reviewing literature about patent indicator and constructing patent value evaluation model identified as suitable indicators for Taiwan. Due to the lack of the citation information in Taiwan patent database, this study will not adopted the citation indicators. We used five indicators to classify litigated patent into different groups, and explored the characteristics of each patent groups. This study samples are 659 litigated patents from 1,476 lawsuits cases suited by Intellectual Property Court from January 1, 2008 to December 31, 2014 in Taiwan. Litigated patent types are respectively 376 utility patents, 214 invention patents, and 69 design patents. 74 litigated patents are winning, 545 ones are failure, and 40 ones are in proceeding. From the reference reviewing there are five indicators adopted in this study are independent claim, number of claim, examination time, patent family, and survival time. The results showed that in Taiwan more utility patents are litigated than invention patents and design patents. The most of foreign patent litigated in Taiwan are from Japan and the United States, followed by Switzerland and China. Patent technology types are A category (Human Necessities), B category (Performing Operations Transporting and G category (Physics). Besides, the value of the five patent indicators in winning litigated patents are all significantly better than the value of failure ones in statistical testing. This study classified litigated patents into “Global Layout”, “Local Layout”, and “Regional Layout”. The independent claim, examination time, patent family, and survival time of patent in “Global Layout” are better than the others and only number of claim show no difference among the three groups. The study suggested that the five patent indicators are suitable for evaluated the Taiwan patent value.
