府會互動關係之研究-以屏東縣鹽埔鄉民代表會為例

摘要
權力始於選舉，選舉始於法治，法治由人民賦予，此乃法治國之精神，我國憲法及增修條文的規定，採行中央與地方垂直分權，為充分發展地方自治事項，制定地方制度法規，定其運作之情形，行政機關與立法機關之權力分立，體現於地方立法機關代議士與地方行政機關首長，由人民選舉產生，各自掌理立法權與行政權，並且分別向選民負責，各有各的民意基礎。而本研究著重於府會互動之關係，而府會互動關係之良窳又涉及代議士問政專業能力以及年度總預算審議之程序。 因此，本研究以質性分析作為研究方法，依一屆次之會議議事錄之內容作客觀之判讀，所得之結果：壹、府會互動關係之良窳，表現在行政及立法機關雙方缺乏溝通及偏見的解讀，導致權力之錯誤運用。貳、質詢權運用不當將影響府會關係互動。參、府會互關係之優劣將影響年度總預算之審議程序。
