學生團體保險運作型態與問題分析

本研究探討我國高中職以下學生團體保險歷年來的變革、法源依據及招標屢次流標所產生的各項問題和經營上的困難。2018年6月學生團體保險新法實施，本研究採文獻蒐集，藉由我國「強制汽車責任保險」制度之法規、實施辦法和各項制度之規範作為學生團體保險參考，讓學生團體保險能夠在法令及制度上更加健全、完善。研究中發現學生團體保險辦法之施行存在諸多問題，本文建議，至少應從四個面向來調整(1)政策執行面: 強化學保政策性保險相關法源，開放適格保險公司共同辦理；(2)財務面:健全學生團體保險朝無盈無虧財務獨立穩定之方向發展；(3)業務面:回歸學生團體保險辦法，開放各縣市獨立招標，保險公司自由競爭、小區域經營以提升服務品質；(4)管理面:建立監理、監督之法規制度促使本保險制度能健全運作；整個體制做調整，才能使學生團體保險得以健全發展。

This study investigates the changes and legal basis, various problems arising from multiple failed bids in bidding, and operational difficulties of group insurance for students in general and vocational high schools or below. With the implementation of new regulations for student group insurance in June 2018, this study compiles literatures and uses the laws and implementation regulations for “Compulsory Automobile Liability Insurance”, and specifications for various systems in Taiwan as reference for student group insurance, so that regulations and systems related to student group insurance can become more sound and complete. Based on the findings of this study, there were many problems with the implementation of regulations for student group insurance. Hence, this study suggests that these regulations should at least be adjusted in four aspects: (1) Policy implementation: Strengthen sources of laws and regulations related to act insurance for student group insurance, and open up insurance companies to jointly engage in this insurance; (2) Finance: Improve student group insurance toward financial independence and stability without profit and loss; (3) Business: Return to regulations for student group insurance, open up independent bidding in all counties and cities, and enable insurance companies to compete freely and operate in small regions, so as to improve service quality; (4) Management: Establish a regulatory system for inspection and supervision so that this insurance system can run in a sound manner. Only by adjusting the entire system can student group insurance be developed in a sound manner.
