台灣公共工程統包契約發展沿革及應用之案例研究

本研究以公共工程統包契約之發展沿革及應用之案例加以論述，進而彙集相關注意事項、作業手冊及執行疑義與常見問題，並提出三個不同類型爭議之案例：契約發生情事變更問題、統包契約發生物價變更問題及統包契約之智慧財產權之問題，加以探討其公平性及合理性之問題。本研究分析並彙整統包工程制度對政府機關、統包商及PCM間之優缺點，例如：對政府機關而言，將設計與施工同一契約，可減少分別發包作業、藉設計與施工之併行作業而縮短工期，提昇效率及品質；對統包商得統籌設計、施工作業，增加對整體計畫之控制程度，可減少設計與施工協調之時間或成本間浪費；對PCM有利於掌握工程品質，增加現場經驗等。本研究最後對統包工程提出具體建議如下： 1、應就一定範圍的金額及一定程度或提出新式工法或新設計者，以法律定之。 2、應請統包商將其設計除提出設計圖外，應提出設計未來完工之產品模型，可供實際參考評選。 3、依工程里程碑實做實付方式支付工程款或以總價的一定成數之預付款，並由統包商提供一定之保證。

The research was conducted to study the development and application of turn-key contracts for the public construction projects in Taiwan. Project data from selected practical turn-key projects were collected and analyzed to study the commonly encountered issues, on the basis of fairness and rationality, such as (1) change of circumstance, (2) price change of materials, and (3) right of intellectual properties, during the carry out of the turn-key contracts for public construction projects in Taiwan. The analysis and discussion in the study lead to the revelation of advantages and shortcomings of the turn-key contract system to the government agency, contractor, and the professional construction management (PCM) involved in the construction process. The combination of design and construction phases in the turn-key projects could significantly simplify project administration for the government agency and enhance the quality of the construction. Also, turn-key contract could help the contractor more effectively control the progress and schedule of the project by minimizing time delay and technical interference between design and construction phase. As the results of the research, the conclusions of the study are as follows: (1) the use of turn-key contract should be mandated by law for construction projects beyond certain scope and budget, (2) completion model should be provided by the contract bidder in addition to blueprints and drawings as essential documents for the turn-key contract, (3) a certain percentage of prepayment paid to the contractor in accordance with progress of the project should be guaranteed by the contractor prior to the completion of the projects with turn-key contracts.
