Anti-trust Control of Internet Platform Enterprises and Its Analysis Framework - From the Perspective of the Theory of Two Sided Market

摘要

本文利用互聯網平台企業濫用行為管制的相關研究成果，來建構了互聯網平台企業濫用行為反壟斷管制的分析架構，認為平台壟斷對市場進入可能產生的影響，應該成為互聯網平台企業濫用行為反壟斷管制的重點考察對象。經研究結果顯示：在相關市場界定方面，採用傳統的需求替代法和供給替代法界定相關市場。在濫用(abusing)行為的認定方面，則有必要從結構分析轉向行為分析，淡化市場佔有率和市場集中度指標。

Based on the results of studies on abuse control for Internet platform enterprises, this study constructed an analysis framework for anti-trust control on abusing of Internet platform enterprises. It proposed that the possible effects of platform monopoly on market access should become the focus of anti-trust control on abusing of Internet platform enterprises. According to the research results, the relevant market is defined by traditional demand and supply substitution methods. For abusing recognition, it is necessary to change from structural analysis to behavioral analysis and downplay market share and market concentration indexes.
