托克維爾(Tocqueville)之《論美國的民主》作為大學通識教育課程的重要意義
The Significance of Tocqueville's Democracy in America for General Education
摘要
本文的主要目的除了通識課程的教學研究外，也想討論托克維爾《論美國的民主》對於台灣民主政治發展的啓發。就通識教育的教學研究而言，本文認為不論是研究的深度或探討的問題，托克維爾《論美國的民社》是足以作為經典著作，將提供大學生一種整體視野。再就對於台灣民主政治發展的啓發而官，這本書揭示了美國民主政治最根本的精神－法律文明－不但形成具有普遍可溝通的法律規範，更有獨立與公正的司法體系，目前台灣的民主政治的發展就是最缺這些東西。台灣地方社會的樁腳政治如何公共化，一直是台灣民主政治最根本的原因之一，再者則是司法審判不夠貼近日常生活，本文認為托克維爾《論美國的民主》可以提供這些問題很好的啓發，而正視台灣民主政治發展的問題所在，而非只是學其形式。

Besides the research of general education, this paper also discusses the enlightenment of Democracy in America to Taiwan democracy development. As for as general education, Democracy in America not only can give the student a general view, but also let student understand the essence of democracy: the independence of judicial system which is near the everyday life. Unfortunately, current Taiwanese democracy development is lack of that.
