摘要

派遣勞動在台灣已逐漸盛行，行政院經濟建設委員會將其列為今後五年內重點發展之12項服務業之一。勞工委員會並於今年（2004年）9月完成草擬勞動派遣法之工作，準備於下會期送立法院審議。勞工團體認為派遣勞動有中問剝削、強制勞動、及勞動力買賣之危險性，政府應依勞基法規定取締，不可使非法勞動派遣業者就地合法，置勞工權益不顧。筆者認為現階段政府對派遣勞動採自由放任政策，如不立法規範派遣機構及要派機構，派遣勞工將更無保障。

The temporary work has been gradually popular in Taiwan. Council of Economic Planning and Development under Executive Yuan in Taiwan, R.O.C. will include it as an important development of one of 12 service industries in the next five years. Council of Labor Affairs redacted the temporary work law in September this year and is ready to submit it to Congress Legislative Yuan during the next term. But Labor groups said that temporary work could have risks such as exploitation, forced work and marketability of labors, therefore the government should suppress it, according to Labor Laws and Regulations. None of the illegal temporary agency should be legalized. Those groups suggested that the government should pay more attention on labors. This author thought that now the government has a free policy for temporary work, so it should regularize all the temporary agencies, otherwise the temporary labor would under no protection.
