休閒農場農業建築使用議題之研究

Study for Agricultural Building Application Issues of Leisure Farm

摘要


休閒農業之經營靜、利用農業資源,結合自然景觀、生態資源、農村風貌,提供民眾休閒活動。其中,農業建築於務農、農暇之餘,為提供休閒農業經營之重要資源與場所。而休閒農場依法須申請設立(包括籌設許可、設施興辦許可、設立許可)始得經營。農場內之農業建築興建與設置,以建築物生命週期(life cycle)觀念,其建築行為歷經規劃、計畫、設計、施工、使用、拆除等階段,同時涉及土地使用管制、建築管理、使用管理(含公共安全)等,對於業者而言,不諳行政規定常造成請領設立困惑。本文以專案輔導休閒農場內農業建築為題,從建築管理及再利用觀點探討農業建築機能選擇。經調查農業建築其使用以住宿、餐飲、展售(示)、教育解說、體驗等性質為主,再利用率達各農場內農業建築總面積40%。然而,業者自行設置建築物、或改變原有建築用途之情況十分普遍,在行政程序與法治觀念上仍待補強。迄今業者合法化過程所遇窒礙難行之處以土地使用、建築管理為主,探究其因,於1990年以政策推行休閒農業而法令不甚完備之背景有關。最後,本文研究成果可供業者選擇農業建築物作休閒農業使用合化程序之參考,及提供主管機關適用相關法規與行政程序上之建議。

The management of leisure farming is to employ the agricultural resources, integrate natural views and sceneries, ecosystem resources and the original looks of farm villages so as to provide leisure activities for the general populace. Within these, agricultural building in the context of leisure farm during the timeframes between farming activities and breaks serves as the vital resource and arena to provide leisure farm management. Nonetheless, leisure farm must be applied and established according to laws prior commencement of operation (including permits for planning, installation building and establishment). Agricultural building establishment and installations within the farm should base on the concept of building life cycle. The building behaviors should go through phases like planning, designing, work implementation, usage and dismantling as well as involve land use control, building control, usage control (including public safety) in addition to management rules and regulations for the operation registration, etc. This could create the perplexed and puzzled scenarios in management for those farming proprietors who are not familiar with administrative regulations. This thesis is based on the theme of project counseling the agricultural buildings within the leisure farm context and explores agricultural building functional options from the perspectives of building management and reuse. From the survey, it is known that the usages for agricultural building within the leisure farm context are primarily dedicated to the roles like lodging, dining and food service, exhibition and sales, educational illustration and farming experiences. And ratios for adaptive use can reach as high as 40% of the total area for agricultural buildings within the farms. Nonetheless, the self-installed buildings within the farm and relevant usage changes are quite prevalent; therefore there are still much desired pending conceptual enhancements of agricultural building reuse for the management and proprietor as well as administrative procedures. In light of the above, the research findings of this study are expected to provide proprietor as recommendations in selecting agricultural buildings as the use for leisure farm and abiding by the rules and regulations, as well as serving as recommendations for suitable relevant rules and regulations for the governing authority and administrative procedures.
