平成觀護法之啟示與我國觀護法案之芻議

摘要

邇來，日本爲順應世界潮流而大舉變革觀護法制，在彙整成一部專法之後，促使其發展更上一層樓。回眸我國司法改革在犯罪者處遇體系遠遠不及犯罪偵查、審判體系之實踐，放任一甲子專法闕如而單純借用保安處分執行法其中寥寥數條運作，較諸日本的與時俱進，直教人心虛汗顏。尤其甚者，觀護體系長期寄宿於行爲本質全然迥異的檢察機關，吊詭的羽翼關係及過度的鄰接業務，益使業務難脫多藝不精的窠臼，遑論專業。鑑此，吾人洵應急起省思值此政治輪替之際提出法案芻議，建構本土化之觀護專業，始於整體司法與社會有益。爰以基層之務實理念及觀護學理擬議，俾以拋磚引玉。

Recently, Japan to meet the world trend, the concept of substantial change for the rule of law, in the whole of the law into one, to promote the development of a higher level of the system. Recalling that the judicial reform about the system of criminal treatment in Taiwan is far less than the practice for the criminal investigation and the trial system, just only depend on some provisions in the implementation of sanctions which the Security to operation allowed for several decades without the rules. Compared with Japan, it is feel very guilty conscience. In addition, because of boarding long-term that District Prosecutorial organs nature of the acts completely difference, the paradox of the fledgling relationship, and over the adjacent business, the more difficult it from the chaotic result, it is let alone professional. In view of this, we should catch up them, to taking advantage of the change of political opportunity, and introduce bills reflect on the recommendations to construct the localize probation professional, then it will be useful to the overall justice system and society. So I would base on a grass-roots worker to make recommendations according to the pragmatic idea and probation academic, to offer a few ordinary introductory remarks so that others may offer their valuable ideas.
