摘要

性罪犯的評估與處遇是抑制性罪犯再犯的關鍵，新修訂的性侵害犯罪防治法更於第20條賦予地方法院檢察署的觀護人可以對接受保護管束之性罪犯進行密集約談、訪視、採驗尿液、限制住居、報請檢察官或軍事檢察官許可施以宵禁及實施測謊。這些新增措施盼能提高社區處遇對於性罪犯再犯危險的監控，協助社區處遇能更有效地達成目的。影響性罪犯是否再犯的因素相當多元且複雜，處遇者學能是否夠應付專業需求？能否全面掌握性罪犯之犯罪原因，是影響其處遇是否有效以及是否能深入監控性罪犯預防再犯的關鍵要點。本文試圖以一個案之評估與處遇為例，討論性罪犯處遇與再犯預防監控之問題，提出可提供現行擔任性罪犯評估及處遇專業人員參考之建議。

Assessment and treatment of sexual offenders is very critical to inhibit recidivism. The article §20 of the lately revised ”Prevention & Treatment Law for Sexual Crimes” regulates that the probation officers have the right to implement intensive interview, intensive visitation, urine test, living limitation, or night curfew and lie detection to the offenders under the approval of prosecutor. These new regulation and measures were designed to monitor the potentiality of sexual offense recidivism and to promote community safety. However, factors influencing relapse of sexual offenders are multiplex. It is imperative that therapists should be able to capture the underlying causes of sexual offense and identify risk factors of the offenders. This article aims to present a case report in which the assessment of sexual offense behavior and the process of treatment were introduced, and make suggestions for practitioners who deal with sexual offenders.
