醫療過失中的因果關係：從邱小妹人球案談起

摘要

關於因果關係，我國實務判決一向採取「相當因果關係理論」。這與德國刑法上的「條件因果關係理論」與「客觀歸責理論」並不相同。然而，近年來，在醫療過失案件中，實務判決越來越多的案例是以「合法替代手段」與「結果迴避可能性」之概念，論斷相當因果關係之有無。換言之，在我國刑法實務的運作下，相當因果關係理論的內涵已與原始理論中以排除異常或反常因果為任務之見解不大相同，而是藉由「結果迴避可能性」之概念對相當因果關係進行補充。這個趨勢似乎宣示了，相當因果關係理論的鬆動，且有逐步向客觀歸責理論靠攏的意思。本文以邱小妹人球案作為出發點，探討醫療過失中的因果關係問題。其中除了探討我國、德國與日本刑法學說上對於因果關係理論之看法外，並且蒐集與整理近年來醫療過失案件中，實務判決對於因果關係理論的看法走向，藉由實務判決與刑法理論的比較與對話，勾勒出我國相當因果關係的特殊面貌。

In Taiwan, the criminal law is based on ”adequate causation theory,” which is different from German's ”condition sine qua non” and ”theory of objective attribution.” However, more and more court decisions are based on ”potentials of avoidable results,” supplementing to adequacy theory. The tendency shakes up adequacy theory and moves towards the theory of objective attribution.This study begins with the case of a little girl Chiou, examining the causation in cases of medical errors. Apart from examining theories of causation in criminal law in Taiwan, Germany, and Japan, this paper collects and compiles court decisions' impacts on causation in cases of medical errors. Through comparison and dialogue between court decisions and criminal law theories, this paper presents a unique contour of relative causality in Taiwan.
