摘要

1、大學乃學術中心、傳授知識並做深入之研究，有知識、道德與應用能力之目的而加以設置之機構。所以大學的成果，有某種程度應向社會做公開的發表。2、大學中除屬於不正競爭防止法中之營業秘密外，還包括許多資訊，例如未發表論文、著作、提出專利申請前之文件、入學考試試題、學生成績等個人資訊，原則上都應進行秘密管理。也就是說大學營業秘密之管理，是其資訊適切管理之一部分。3、一般而言，營業秘密管理的目的乃基於以下兩點（1）保護自己的財產；（2）禁止他人侵害自己的營業秘密。
