摘要

共同研發下，涉及共同研發人彼此在進行計畫前所各自擁有技術的投入，以及共同研發人應如何使用投入之技術；其次則是共同研發產出之研發成果，如何定其歸屬與運用，這些都是共同研發下的重要課題。歐盟FP7以共同研發爲執行計畫之主要模式，對於共同研發所衍生之議題有成熟的法制及法律輔導平臺，可爲我國共同研發促進機制之發展提供豐富的經驗。

Joint R&D involves that joint R&D performers dedicating their originally own technology to Joint R&D and how to utilize these technologies between performers. Moreover, how to decide the ownership and the utilization of the results from joint R&D are key issues of Joint R&D. Because the main model of European Seventh Framework Programme (FP7) is joint R&D. Therefore, FP7 has mature legal system and law consulting platform regarding issues derived from joint R&D. And it can provide abundant experiences for developing facilitating mechanism of joint R&D in our country.
