摘要

隨兩岸交流及合作環境之成熟與到位，兩岸於今(2010)年6月29日第五次江陳會談中，正式簽訂「海峽兩岸智慧財產權保護合作協議」。目前，業已依各自規定完成相關程序並相互通知，兩岸智財權保護協議於9月12日正式生效。對於兩岸智財權保護協議之訂定，國內各界對其有不同意見；兩岸智財權保護協議究應如何解讀？是否能夠確實提供智慧財產權保護上之價值及貢獻？在後續發展及實務運作上所應留意及觀察之處爲何？本文將對之進行介紹及分析。

Taiwan and China signed an agreement for the protection of intellectual property rights (IPR) in June 2010. Under this agreement, it implies that each side recognizes the priorities of the other and that both agree to process applications for IPR protection. In addtion, Taiwanese and Chinese agencies have been nominated to take charge of an IPR dispute resolution process. This paper analyses the highlights and implications of the agreement. At last, it provides several explicit suggestions to the Taiwanese industry.
