網路數位時代下之營業秘密保護探討－從美國白宮減少營業秘密竊盜管理策略談起

On the Protection of Trade Secrets in the Digital Age - From the View of Administration Strategy on Mitigating the Theft of U. S. Trade Secrets

摘要

在網路數位時代下，如何有效防止不肖份子運用資通訊科技竊取重要營業秘密，以避免企業或產業經濟遭受損失，已是有關當局必須重視的課題。我國於2012年著手營業秘密法之修法，並於2013年通過修正草案，新版之營業秘密法，針對侵害營業秘密行為課予刑事責任，同時，將所取得之營業秘密，使用於我國境外者，亦一併課予刑事責任。惟此等措舉是否足以因應網路數位時代下，營業秘密所受到的威脅，或有必要再為進一步探討。為此，本文乃針對美國防治營業秘密竊盜之策略與立法趨勢進行探討，以作為在網路數位時代下我國防治營業秘密竊盜之參考。

It is of vital importance how we shall deal with the issue of trade secret thefts in the digital age to mitigate the loss suffered by industries and enterprises. Our government amended Trade Secret Law in 2013 to make theft of misappropriation of trade secret a crime, including conduct outside R.O.C. However, whether those measures can effectively mitigate theft or misappropriation of trade secret may need further review. In this paper, the strategy and legal actions taken to mitigate theft or misappropriation of trade secret by USA was introduced and compared to those taken by our government and thus the suggestions on protection of trade secrets was proposed.
