摘要

封鎖制度隨著時間演進，科技的進步，已經脫離了傳統封鎖之面貌，有時海權強國會為規避封鎖規範之適用，於近代戰爭實踐專屬水域與禁航區，作為達到其軍事利益之工具，加上國際法法典化後，國際習慣與國際社會之需求已形諸於文字，無法再以單一思考模式去檢驗其合法性。本文期望藉此探討封鎖型態之轉變，俾利我國對於國際實踐趨勢與其合法性基礎，有所瞭解。

The evolution of blockade over time, technological advances, have been away from the traditional blockade, and sometimes the sea powerful countries avoid to circumvent the application of blockade, and use the practices of exclusive zones and the no-fly zones as a tool to achieve its military interests. Together with the codification of international law, international custom and the needs of the international community has shaped all the text, no longer a single mode of thought to test its legality. This paper intends to investigate the blocking pattern of change in practice to serve the international trend of interest of its legitimacy, and to understand.
