公設財團法人具有遂行特定行政任務之功能,設立目的在於協助政府推動公共政策,其與民間財團法人之區別不以捐助與否為限,端看政府是否影響並介入內部業務之運作,包括政府任命之董事席次是否過半,以及政府是否擁有董事任命之權力等。然隨著台灣政治經濟環境的變遷,由於民主意識的提升、法制環境的強化,公設財團法人開始面臨合法性與正當性的質疑,加上近年來公設財團法人在法律、人事、財務陸續出現許多弊病,遂開始引發各界對於公設財團法人之質疑。 本文發現公設財團法人衍生之問題涉及民主、法制原則,轉型有其必要性與急迫性。為尋求解決公設財團法人相關問題之方案,本文嘗試就現有可供公設財團法人轉型之選項中,整理出行政機關化、行政法人化、民營化、去任務化以及維持現狀五項;在轉型規劃上,藉由類別化標準的建立,將現有公設財團法人分為特殊法人型、政府職能型、資源浪費型、民間興辦型及例外型,建議之轉型方向分別為行政法人化、行政機關化、去任務化、民營化及維持現狀;最後,藉由實際個案的操作,評估未來轉型時可能面對的各項困難,以提升公設財團法人轉型的可行性。
GONGOs have its administrative mission, and the objective of GONGOs is to assist government realizing its public polices. The verification of GONGOs does not depend on whether the donations are from government or not, it depends on whether government involves their internal affairs, which includes governmental representatives in the board and the power of assigning the board of members. With changing political-economical environment, rising democratic awareness, and increasing legal environment strength in Taiwan, GONGOs have been questioned of their legitimate and rightness. Moreover, there has been a lot of disadvantages coming out of GONGOs in aspect of legal affairs、recruitment、finance, which arises voices of reforming GONGOs. This research discovers the disputable issues of GONGOs involving the principles of democratic and legal institutions, as a result, transform of GONGOs has its urgency and necessity. In order to find out alternatives of resolving problems of GONGOs, this research tries to approach existed directions of transform of GONGOs, and concludes five options, which are administrative organizationalize, administrative juridical personalize, privatize, deregulationalize and status quo. In the transform plan, due to establishment of categorical criteria, we categorize GONGOs into types of specific juridical person, governmental responsibility, resource wasting, NPOs and exceptional organization. The directions of transform that the research suggests, respectively, are administrative organizationalize, administrative juridical personalize, privatize, deregulationalize and status quo. At the end of the research, we assess all difficulties we will face during the transforming by implementing existed cases, and enhance the possibility of the transform of GONGOs.
