校規是用於規制大學的秩序,保障學術自由的促進及學習自由的工具。但在現行大學運行的實務下,似乎已然成為學校對學生的管制工具。校規的法律性質,在學說上均有相當多的討論及爭議,在於其法律性質有所變化的情形下,其內部拘束力會產生微妙的變化。在我國繼受外國法制下,有認為我國校規的法律性質應認定為公法性質,也有認為應為私法性質。然而,在適用外國法制前,必須先對我國實務現況下的法律關係,與大學的法律地位為認識,方可能為釐清。本文首先說明大學與大學生之間的關係與變化。其次以大學的在學關係的觀點切入大學校規的法律性質的討論。接著,著手討論公私立大學的法律地位,以點出公私立大學的異同,以便討論其校規的性質,隨後提出我國的學說爭議,再加以確立我國公私立大學的校規的法律性質。
School Regulation is a method of disciplining order of university, guaranteeing the freedom of academy and promoting freedom of studying. But in the practice of university, by now, school regulations seem to be university controlling instruments to indoctrinate university students. In terms of the character of school regulation, there are various discussions and debates on theory; furthermore, under the changing of legal character, its internal binding power will bring about subtle changes. Since our country inherits foreign legal system, some consider school regulation shall be recognized as bearing the character of public law, while others render it with the character of private law. However, before applying foreign legal system, we should know our country's legal relation under the situation of practice and the legal status of university at first so that such clarifying will be possible. First, this paper explains the relation and change between universities and university students. Second, from the aspect of university's relation with school, this article discusses the legal character of university regulation. Then this article will move on to discuss legal statuses of public and private university, and then point out the differences and similarities between public and private university. Finally, this paper enumerates the disputes on theory of our country to define the character of school regulation of our countries' public and private universities.
