民主進步黨憲法原住民族專章草案的檢視

An Examination of the Special Chapter for Taiwan Indigenous Peoples of the Democratic Progressive Party's Draft Constitution

摘要

民國95年，當時執政的民主進步黨為準備推動第二階段的憲政改造，而進行〈中華民國憲法修正案〉的研議，並於其中增訂了〈原住民族專章〉，表達了對於臺灣歷史與原住民族的高度尊重。但卻也因為其間頗多具有創新的憲法概念與主張，而使〈原住民族專章〉的內容與可行性，受到諸多的議論。本文期待透過其間條文的一一檢視而能對於重要問題有所釐清。

In 2006, the Taiwan ruling Democratic Progressive Party drafted a constitutional amendment for promoting the second phase of Constitutional reengineering. At the same time the Democratic Progressive Party drafted a special chapter for expressing their highest respect for Taiwan history and indigenous people. Since there are many innovative constitutional concepts and ideas in the constitutional amending's special chapter regarding indigenous people, the content and feasibility of the special chapter are doubted generally. This article looks forward to examine all the provisions and clarify all the issues.
