本研究瞭解公務機關運用勞務契約承攬人力情形,因此,本文研究問題為:(一)機關在勞務契約承攬人力目前的運作現況存有何種問題?(二)機關如何運用勞務契約承攬人力,讓業務能順利推動?(三) 在勞務契約承攬人力的運用過程,應如何進行指揮監督與勞動權益保障? 本研究採深度訪談方式,訪談對象為研究機關相關人員,經研究發現相關議題為(一)勞務契約承攬人力為補足正式職員人力不足之替代措施。(二)勞務契約承攬人員的勞動權益不佳。(三)指揮監督權界限區分不易。(四)勞務契約承攬人員穩定性及未來性疑義。 政府應該站在人民的角度去改善不友善的工作環境,為勞務契約承攬人員工作穩定,權益更有保障,使其對機關更努力工作,避免一味地以降低成本為考量,更加應以宏觀的角度提升社會價值方向來做為考量。
This study discusses the related issues about hiring workforce through contracting-out in public sector. The study questions are: (1) What are the current problems in the current operation of hiring workforce through contracting-out in public sector? (2) How to use the hiring workforce through contracting-out in public sector so that the business can be promoted smoothly? (3) How should command supervision and labor rights protection be conducted in the process of using hiring workforce through contracting-out in public sector? This research adopts in-depth interviews. The interviewees are related personnel of research institutions. The research found that the relevant topics are (1) hiring workforce through contracting-out in public sector is an alternative measure to make up for the shortage of formal staff. (2) the service contract are not sufficient. (3) It is not easy to distinguish between the power of command and supervision. (4) The stability and future doubts of hiring workforce through contracting-out in public sector. The government should improve the unfriendly working environment from the people’s point of view, work stability for the contracted personnel, and protect their rights and interests, so that they can work harder for the organ and avoid blindly considering cost reduction. Angle to enhance the direction of social value as a consideration.
