美國從一九四○年代就興起「政策法學」的概念;復於一九六八年起迄今,更在學者D.Waldo的領導下,進入「新公共行政」(New Public Administration)的時代。對照於此,台灣的政策法學是否已經興起?台灣的新公法學派以否已經形成?又將如何形成?此等問題值得深思,爰此本文選擇以法律政策的憲法論證為例加以探討。在內文中,作者認為我們若能夠引進公共政策學的角度來看待台灣的「法律」,尤其是立法過程及司法解釋的理解,那麼台灣也可有台灣的政策法學。在政策法學的基礎上,事實上,我們也需要不同於引進德國式、日本式思維的「傳統公法學」,我們也應該走向「新公法學」,建立台灣的「新公法學派」。
In this article, the author is trying to construct the feasibility of Taiwanese New Public Law, which the concept is borrowed from the New Public Law of the study of legal policy and New Public Administrative Movement in the United States of America since 1940s and 1960s. For this purpose, the author also cites an example of how the Constitutional Argument could be used, which can help the development of interpretation of constitution of legal policy study.
