本文從言論自由的理論出發,探討網際網路上「有害內容」與法律規範的問題。本文在結構上分為三部份:第一部份為言論自由理論之分析;第二部份介紹美國及歐盟對網際網路有害內容之規範情形;最後部份則探討我國對網際網路有害內容之管制狀況。研究結果顯示,美國與歐盟對其境內違法之有害內容有不同規範,然而對於灰色地帶之有害內容,則以為政府不應介入管制,希望交由科技本身、自律或教育等措施來解決。我國目前對於違法之有害內容,現行法律已有規範;至於法律所未規範之灰色地帶部份,則鮮有討論。有鑑於此,本文除針對「有害內容」加以探討外,並提出管制此類網際網路內容之可行方案。
This article discusses the regulation of ”harmful materials” on the internet. The structure of this article is divided into three parts: Firstly, focus is placed on the analysis of the theories of free speech. Then, laws of the United States, the European Union regarding the regulation of harmful materials on the internet are examined. Lastly, relevant laws of Taiwan are briefly analyzed.This article concludes that, apart from sheer illegal materials, governments should not intervene too much in the regulation of the so-called 'gray area' materials on the internet. Instead, they should be resolved by technology and self-regulation of the internet service providers (ISPs). Some possible solutions are suggested in the end.
