摘要

為保護植物品種權之權利，促進品種改良，並實施種苗管理，以增進農民權益，訂定「植物品種及種苗法」，對植物品種權利保護及種苗業管理兩部分加以規範。在植物品種權利保護方面，主要規範品種權利之申請審查、內涵、品種權利限制、消滅、撤銷、廢止及維護等項目，凡具有新穎性、可區別性、一致性、穩定性及一適當品種名稱等要件，均可申請植物品種權保護。而種苗業管理部分，則規範種苗標示及檢查、輸出入、基因轉殖植物之管理等項目。

An act is enacted to protect rights in plant varieties, facilitate improvements in plant varieties, and implement a plant seed administration system in order to promote farmers' interests. In plant variety right include variety right application, content, and maintenance. A plant variety that has the characteristics of novelty, distinctness, uniformity, and stability, as well as an appropriate plant variety denomination, may be the subject of an application for a plant variety right in accordance with this Act. In plant seed administration include seed certification, inspection, importation and exportation as well as transgenic plant administration.
