成人性交易專區沿革初探
History Exploration of the Adult Sex Trade Zone
摘要
臺灣社會因受到我國固有父權社會觀念及日本殖民時代存留的文化影響，對於性交易服務多保持允許或默許的態度。臺灣的公娼制度緣自於日本殖民時代，分為陪侍和賣淫兩個區塊，至今具有100年的歷史。我國對於「性交易」是否除罪化，政府及社會大眾始終對此一議題，處於紛紛擾擾的局面，沒有一個確切的政策定論。終至98年11月06日，司法院作出釋字第666號解釋，明示『社會秩序維護法第80條第1項第1款「罰娼不罰嫖」規定，違反憲法平等原則，至遲於100年11月6日，失其效力。』這才真正確立了「性交易專屬區域內除罪化」的政策原則。依據100年11月4日修正公布（同年11月6日生效）社會秩序維護法第91條之1規定，已將性交易專區合法化，惟該法通過至今各地方政府尚未有設置專區之實際行動，甚至表明不會設置性交易專區，使該法徒流於形式與虛設。為此，本研究茲以我國成人性交易合法性之初探，參考他國的經營管理方式，期求能針對「地方政府設置性交易專區」議題建立一研究基礎，未來就「管理」及「產業」二大面向，從「法律衝突」、「政治考量」、「人口地域」、「市場供需」、「道德層面」等五個議題，進行後續研究、探討並予以提出參考建議。
