警察處理社維法違序行為態樣與區域關聯性之研究

摘要

本研究係以大數據分析，進行瞭解警察處理違反社會秩序維護法之行為與區域間之關聯性，運用文獻探討、官方次級資料分析、內容分析法等方法進行研究，研究樣本以2015年至2019年各地方法院簡易庭裁定書類12,079件裁定書為範圍，發現：警察機關處分之案件，集中在性交易、賭博及妨害安寧秩序案件之執行，法院簡易庭裁定案件，集中在無正當理由攜帶具有殺傷力之器械、攜帶類似真槍之玩具槍，吸食或施打煙毒或麻醉藥品以外之迷幻物品，妨害公務與加暴行於人、互相鬥毆者等違序，在區域上，較集中在高雄市、台中市及臺北市等直轄市都會區，縣市地區則以臺灣北部、中部地區取締案件量較多；依研究發現建議：強化警勤區吸食毒品以外迷幻物之查察與媒介性交易違序行為之監控，避免衍生成為隱性毒品人口及人口販運行為等建議，供實務機關參考。

This study carried out a big data analysis in order to explore the relevance between the behavioral patterns of the offenses against Social Order Maintenance Act and the regions where these offenses occur. Literature review, official secondary data analyses and content analyses served as the approaches for conducting the research. The samples of this study covered the statistics provided by the Criminal Investigation Police Offices and a total of 12,079 rulings made by District Court Summary Divisions in Taiwan. The findings showed that the offenses against social order the police processed mainly included sex trade, gambling and interference with peace and order. On the other hand, most of the cases ruled by District Court Summary Divisions were in relation to carrying destructive weapons or instruments without any justifiable reasons, carrying toy guns that resembled real guns, taking or injecting psychedelic drugs other than narcotics, interfering with public functions, using violence against pedestrians as well as fighting. When we looked into these offenses by regions, the municipalities such as Kaohsiung City, Taichung City and Taipei City showed higher frequencies. The numbers of offenses banned by the police were higher in northern and central Taiwan. Based on the above findings, it is suggested that inspections and checks on the use of psychedelic drugs other than narcotics and monitoring offenses against social order such as sex trade should be strengthened in every police beat. By doing so, it is then possible to prevent these offenders from becoming potential drug abusers and getting involved in human trafficking. The above suggestions are made in this study for related authorities' reference.
