國內建築物公共安全檢查「申報制度」執行迄今,由於諸多惡性削價競爭及不實檢查簽證、民眾不諳法令而遭致行政處分、或因缺失改善爭議、衝突、興訟而產生之糾紛處理等委託問題,耗費了巨大的社會成本。基於保護民眾的立場,研擬一套建築物使用管理相關委託契約範本以為行政指導實有必要。 本研究藉由目前業界眾多定型化契約案例的蒐集,瞭解雙方的權利義務關係,首先探討其間可能存在的糾紛問題。其次,為深入瞭解建築物公共安全檢查簽證及申報制度的執行狀況,特別針對建管人員、專業檢查人與申報人等三個角度進行特定議題的諮詢訪談,再據以初步整理研擬「建築物公共安全檢查簽證及申報委託契約範本」草案。最後,則邀請建管單位、專業檢查機構、消保團體及法制專家等進行互動之交流溝通,藉由執行面專家交叉檢視契約範本之條款內容,提出應修正及增刪意見。經歸納綜整各方意見,提具合理可行的定型化契約範本。
Since the system of safety inspection, attestation and report of buildings used for the public has been performed, some unexpected problems, such as false contents of inspection and attestation due to price competition, administrative disciplinary action resulting from people’s misunderstanding to related law, or lawsuits or disputes about the improving methods of buildings inspected disqualification, occurred and resulted in big losses of social costs. For public protection, a reasonable standard entrust contact for said purpose is then necessary. The preparation is made by the following procedures. At first, a series of presently used entrust contacts on safety inspection of the buildings were gathered. A first draft was made after analyzing the existing troubles between dual sides and recognizing their rights and obligations and other details. Secondly, the members of the competent authorities of building, professional institutions, consumer protection groups, and other law professionals were invited for discussion. Some suggestions were received from the participants for improving the contracts. Finally, a standard form of entrust contract for safety Inspection, attestation and reports of buildings used for the public was readily prepared.
