摘要

近年來，臺灣許多公共工程持續進行，惟就工程執行面出現許多爭議，尤以監造技術領域之服務費用及給付方式的合理性問題較為突出。現雖有調解機制，但爭議處理往往造成更多時間成本浪費，也間接影響工程進度與品質。
又行政院公共工程委員會於104年修正頒布「機關委託技術服務廠商評選及計費辦法」及相關法令，其修正內容可否適切反映或涵蓋公共工程委託監造服務之特性，對於監造服務契約及上述新修法對監造服務費用及給付方式之合理性，為值得深入研究探討之課題。
本研究於緒論中提出目前機關委託公共工程監造技術服務可能面臨之議題，於文獻回顧中，綜整國、內外相關研究結果，再藉由訪談政府機關工程單位、監造工程顧問公司及舉辦專家座談會以了解監造實際現況，並將各方建議彙整，以完善欲探討之議題範圍。
其次，將重要議題設計為專家問卷，發放對象包括產、官、學界、相關公會等土木工程從業人員及工作內容與監造服務費用有關之審計單位或法務單位。最後，參考專家訪談及問卷統計結果，考量各議題之重要性與可行性，研擬為未來監造相關法條、契約之可能改善方向。

In Taiwan, Regulations for Selection and Fee Calculation of Technical Services Providers Entrusted by Entities promulgated in 1999 have been amended several times. However, the supervision service fees do not match costs generally, and even lower than that of other countries. How to revise supervision consultant fees and payment methods has become the important issue.
In the background of this study, there are listed some problems that the supervision units may face during implementation of public construction. In addition, the literature review summarizes the related studies.
Furthermore, interviews with engineering units of government, supervision units and holding the expert symposium to understand the status of supervision and realize suggestions of the parties. Then, design the expert questionnaire according to the issues.
Finally, considering the statistic results of objectives by questionnaire, this study proposes possible improvement directions about related clauses and system. And the government could refer to this study to create a better environment of supervision and improve the quality of public construction.
