高級中等學校課程綱要法律位階之研究

摘要


教育部於1929年公布「中小學課程暫行標準」、1932年公布「中學課程標準」,其後中學課程迭經修訂,名稱亦有所調整。最近則於2008年公布「普通高級中學課程綱要」與「職業學校群科課程綱要」。無論是標準或綱要,其名稱皆與中央法規標準法第3條的命令名稱相當,但教育部解釋其為教育專有名詞,而非法規命令,故迄今仍未在其下達或發布時,依中央法規標準法第7條規定送立法院。是故,本研究在此背景下,採用文件分析與訪談方法,探求三項研究目的:探討現行普通高級中學課程綱要與職業學校群科課程綱要法律位階之適切性、探析現行普通高級中學課程綱要與職業學校群科課程綱要所屬內涵之法律位階、探討未來高級中等學校課程綱要法律位階之適切性。文件分析對象為普通高級中學課程綱要、職業學校群科課程綱要、高級中學法、職業學校法、高級中等教育法草案、有關課程綱要新聞稿等官方文件;訪談對象則包含法學專家、課程專家、學科專家、教育部法規委員會委員、法官、立法委員,兼採教育與法學的觀點。藉由文件分析釐清課程綱要法規定位問題,透過訪談諮詢專家學者的意見,分析討論未來高級中等學校課程綱要的內涵與法律之關係,供未來修訂高級中等學校課程綱要參考。

The Ministry of Education published “high school and primary school curriculum temporary standard” and “high school standard” in 1929 and 1932. The curriculum standards had been revised several times and the name of curriculum standard had been changed. Recently, the Ministry of Education published “senior high school curriculum guideline” and “senior vocational school curriculum guideline” in 2008. No matter the name of curriculum standard or curriculum guideline, it seems like the name of ordinance ruled in article 3 of central regulation standard act. According to the article 7 of central regulation standard act, an ordinance issued by a government agency by its ex officio or delegated from statues shall be notified or publicized according to its nature and submit to the Legislative Yuan immediately. However, the Ministry of Education explained that the name of curriculum standard and curriculum guideline both are professional term which unrelated to the name of ordinance. Curriculum guideline had not been submitted to the Legislative Yuan so far. Consequently, this study explored the following three issues by document analysis and interviews: explore the appropriateness of legal position in senior high school curriculum guideline and senior vocational school curriculum guideline; analyze the content of senior high school curriculum guideline and senior vocational school curriculum guideline that belong to which legal position; explore the appropriateness of legal position in senior secondary school curriculum guideline. The subjects of document analysis included senior high school curriculum guideline, senior vocational school curriculum guideline, the senior high school law, vocational law, the draft of senior secondary education law, press released related to curriculum guideline, and so on. The interview subjects included legal experts, curriculum experts, subject specialists, member of the Legal Affairs Committee of the Ministry of Education, judge, and the legislators, adopting both education and law’s point of view. Therefore, this study adopted document analysis to clarify the issue about the legal position of curriculum guideline and interviews to consult the views of experts and scholars about the relationship between meaning and laws of the senior secondary school curriculum guideline for the future revision of senior secondary school curriculum guidelines reference.
