日本“文化財保護法”制度沿革略析之二

The Change and Development of the "Cultural Asset Preservation Act (文化財保護法)" System in Japan (Ⅱ)

摘要


日本是一個重視傳統藝術、文化的國家,尤在各面文化的保存上,已有極度蜚譽的成就,不僅是亞洲各國所仿效,亦為國際所矚目。 眾所周知,國內的「文化資產保存法」藉鏡日本的「文化財保護法」之處不少,然而對於日本長期百年餘的努力與研發,卻著墨極少。 因緣於此,本文擬對此面,即其法源的制度沿革,投入些微的析探。尤在歷史背景上,對明治初年的「神佛分離令」政策,以及對應於此,全民走向所謂的「文化財保護」制度的建立及其法源創設等,作一年代順的追縱與析述。 全文分「之一」及「之二」兩篇,依序刊出。

Japan is a country that has made its best endeavors to the preservation of traditional Japanese cultural arts in all aspects. Japan's achievement focusing on preserving its cultural arts has earned a great reputation for countries in Asia to follow, in addition, is of high renown all over the world. As is known to all, the ”Culture Resources Preservation Act” of Taiwan has learned a lot from Japan's ”Cultural Asset Preservation Law (文化財保護法)”, however, we are lacking in placing much emphasis on Japanese centenarian development and researches on it. In view of the foregoing reason, the paper devotes to a little analysis and research on the evolution of the Law, especially in the historical background field of the policy of the ”Shinto and Buddhism Separation Law (神佛分離令)” in the early Meiji-Period. In addition, the paper further aims at tracing and studying the subjects, such as the whole people headed for the establishment of so-called ”Cultural Asset Preservation (文化財保護)” system and its law, etc., in chronological order. The content shall be published in order of (Ⅰ) and (Ⅱ).
