摘要
賭博是一個日常生活中常見的用語，更是人類生活中時常發生的一種行為，雖然賭博二字在現代常被合併使用，但其實賭、博二字有不同的意義，此外，本文並從犯罪學、社會學以及心理學層面來對賭博行為加以探討。 自古以來，中國每個朝代、每個國家皆有禁賭的規定，但中國的禁賭政策與外國的禁賭政策在發展上卻是走向不同的結局，中國的禁賭政策因為施行不力的結果，賭博行為總是禁而不絕，而外國的禁賭政策雖然亦無法徹底阻斷賭博行為，但是他們傾向於將賭性視為是人性的一部分，而走向開放、合法化管制的道路。 本文的立論重心是賭博行為應該要除罪化，因此在本文中即是依此一中心思想為論述核心，嘗試為此一論點提供立論依據，但是為了管制人民的賭博行為，應可效仿外國之經驗，設立專局或是賭博特區予以管制，以便集中管理，而我國於二００九年一月時修正通過離島建設條例，可見我國亦開始朝發展博弈專區的方向邁進，因此本文亦提供設立博弈專區前應注意的先行事項以供參考之用。

“Gambling” is not only a common language in our daily life, but also a behavior that often occurs in human life. Although these two words are usually combined to use in the modern society, these two words actually have their own meanings. Besides, this article will discuss gambling behavior from criminology, sociology and psychology views. Since ancient times, each dynasty in China and each State all have their own policy about gambling prohibition. But the result of prohibition policies in China is different from that in foreign countries. Because the prohibition policies in China weren’t practiced well, gambling behaviors are always took place beyond forbidden. Though the prohibition policies can’t block the gambling behaviors, the foreign countries tended to regard bents of gambling as human nature instincts. Because of their tendencies, the foreign countries select and adopt to make gambling behaviors open and to be legalized. The argumentation of this article is based on decriminalizing gambling behaviors, therefore, this article was tried to find some reasonable and supportable theories for the argument. Besides, in order to restrain people from gambling and to centralize management, we should learn and imitate the foreign experiences of establishing a bureau or a gambling area. Our country passed a regulation about developing gambling area in January 2009, this movement perceives that our country is also beginning to proceed with gambling area development. For that reason, this article provides some points that should be noticed before setting gambling area for references.
