面對全球知識農業的衝擊,台灣農業正處於轉型階段,為期能在國際間佔有一席之地,各國政府積極透過農業生技發展來調整傳統的農業結構。然而在各國提升農業生技產業競爭力之際,專利申請與佈局將扮演關鍵性重要角色。本研究目的在建立農業生技專利檢索策略與透過專利分析,探討國際農業生技專利發展之趨勢與各國在技術研發能量之發展方向,提供我國農業生技技術發展之參考。結果顯示基改植物與生物性農藥為近年各國農業生技專利申請之主流,飲食多樣化之亞洲國家在保健醫療食品之農業生技專利上較具優勢,且農業生技專利權多集中於美國和日本。台灣的農業生技專利近年來雖有明顯增加,然而中國、韓國亦有急速發展現象。為了使台灣未來在農業生技發展有競爭優勢,政府除了須強化農業技術智財權概念,並應依國內農業利基建立農業生技發展外,另可藉由政府協助加強國際專利佈局,將無形智慧技術變為有形資產,以對整體產業鏈進行佈局規劃,達成農業生技研究成果商品化與產業化,將可促成我國農產業的轉型與升級。
Taiwan is now in a transition stage brought about by the impacts of global knowledge agriculture. Patents play an important role in the core competency of each country, because they use patented biotechnology as a means to develop their agriculture to a new level. This study retrieved agro-biotechnology patents to understand the global agro-biotechnology trend and R&D capacity, which then provided background information for technology development in Taiwan. The results show that genetically modified crops and bio-pesticides have been the mainstream for recent years. The United States and Japan hold most agro-biotechnology patents and Asian countries have advantages in healthcare and food science. According to the findings, Taiwan's government should strengthen the concept of agricultural technology intellectual property rights and identify niches for agro-biotechnology development, even though Taiwan has more agricultural technology patents than China and Korea. Patent is a concept that can transform technology into a valuable asset, which may lead to the commercialization of agro-biotechnology research achievements and promote the industrial transformation of Taiwan agriculture.
