摘要

農地從事「遊客休憩使用」所衍生非「農業使用」及不符土地使用管制情事，至2009年6月止休閒農場內遊客休憩設施未完成合法化情況十分普遍，亟待因應。本文以農地農用政策為基礎，從土地使用管制與法制觀點，探討休閒農場土地使用與規劃課題。以非都市地區專案輔導之休閒農場為研究對象，歸納出農地作休閒農業使用限制。研究結果發現，法規體制與行政管理對於休閒農業發展深具影響，包括：休閒農業屬農業範疇、休閒農業設施為農業使用、休閒農場歸類為農地等；其中以土地使用管制及建築管理為主要限制，反映專案輔導實施困難所在。經議題討論，本文就現行法規與執行制度提出建議，提供業者於合法化過程之參考，提升休閒農場專案輔導實施效益。

The nonagricultural use and controlled and restricted phenomena unregulated by land use requirements resulting from practices such as the use of farmland for tourist and recreational purposes are becoming quite common as of June 2009. This situation desperately needs, especially due to the lack of legalization related to tourist and recreational facilities. This study is based upon policies stipulating that farmland will be used for agricultural purposes, in conjunction with perspectives related to land use control and legalization. Based on these various perspectives, we explore topics like leisure farmland use as well as planning issues. The survey subjects selected include leisure farms under special counseling projects. This study summarizes the restrictions on the non-urban area use of leisure farms. The research findings indicate that the legal system and administrative management could significantly impact the development for leisure farms. This could lead to leisure farms within the scope of agriculture, leisure farm facilities dedicated to agricultural use, leisure farms categorized as farmland, etc. Among these various types of leisure farmers, the main restrictions include land use control and construction management These issues are fully exemplified in the implementation difficulties observed during the project counseling phase. After extensive discussion of these topics, this study proposes recommendations opposed to the existing laws and regulations as well as an implementation system. The results of this study can serve as a reference for proprietors involved in the legalization process and ultimately, achieve the purpose of promoting the effectiveness of implementing leisure farms under special project counseling.
