While contract termination or cancellation (hereinafter referred to as "termination") occurs in public construction projects, it not only postpones the completion date of the contract but also increases the budget due to subsequent re-tendering process. In this case, it has been acting as a waste of government resources and shows no sign of stopping. This study attempts to organize the patterns of mistakes that cause contract termination and focuses on corresponding strategies to recognize high risk factors of contract termination. This is done through literature reviews and professional discussions about the factors of contract termination. In order to reduce the losses caused by contract termination, corresponding strategies should be prepared to deal with high risk factors of contract termination in advance. In addition, this study will propose average time needed for subsequent procedures after termination for organizing party's reference.
公共工程執行若遇終止契約或解除契約(以下統稱解約),除延長履約期限外,也可能因重新發包而增加預算。如此浪費國家資源的行為,未有減少的跡象。本研究經由文獻回顧及專案探討解約的發生原因、整理出解約情事的錯誤樣態,並針對因應對策,建立解約之高風險因子,並回饋給主管權責機關。提供未來在執行計畫時,針對此解約高風險因子,提早針對因應對策作準備,以減少解約時所造成的損失。研究結果將提供錯誤樣態相對應的策略及高風險因子,回饋主管機關可以事先修成錯誤。其研究結果確實可以減少因終止契約或解除契約所造成的損失,並且縮短契約終止後,後續處理程序所需的平均時間,供主管權責機關執行此作業之參考目標值。
