工程承攬契約之解除與終止

摘要


工程承攬契約常因承包商之工程進度落後嚴重、施工品質查驗不合格拒不改善或無故停工,業主無法提供用地、遲不簽發開工通知或政策變更無法履約等因素,以致發生契約約定或法定之解除或終止事由,一方當事人依法或依約行使解除或終止權,則後續之法律關係為何?業主如何接管工地,並辦理後續結算事宜?本文彙整相關實務見解,進行探討分析,並提出契約面與執行面之預防注意事項。

Release and termination the construction contract under the law or contract conditions such as serious delay of construction schedule, worse construction quality or stopping work without reason by contractor, as well as employer didn’t provided the land for construction, delay in issuing NTP, or cancel the contract. Once the contract was released and terminated, what will be the legal relationship between employer and contractor? How the employer to take over the site and settle those has not completed work. This paper discusses several practice legal points and submits preventive suggestions for both contractor and employer.
