中共中央社會治安綜合治理委員會之研究：協力治理觀點之分析

協力治理（collaborative governance）已成為民主的公共行政運作的一個重要模式，此模式建構了一個跨機關部門、跨組織層級及跨公私領域之協力結構與運作流程，期望能作出周延的公共決定，解決日益複雜的公共問題。簡言之，協力治理模式強調組織間的網絡關係，有別於科層官僚型模的層級節制模式。本文擬探討協力治理的理念內涵及其應用上的相關問題，並以中共中央社會治安綜合治理委員會（簡稱中央綜治委）為例說明之。中央綜治委成立於1991年，是中共黨中央與國務院關於加強社會治安的決策機制，負責重點協調、推動與解決涉及多個部門的社會治安重要事項。中央綜治委曾於2011年8月更名為「社會管理綜合治理委員會」，但2014年7月15日恢復原有名稱，原有40個成員單位，2011年8月更名後，增加了11個部門為成員單位，專項組也從先前的5個，增加為8個，分別由一個部門作為主辦（牽頭）單位，負責協調其他相關成員單位「齊抓共管」，以達成各專項工作目標。總之，協力治理的模式在理論上較適用於處理複雜且屬跨部門的工作項目，但中央綜治委是一個由中共黨中央進行政治、組織與思想領導的網絡，是以實現中共政治權威為目標，其行政效率與效能目標，本就排列在政治權威之後。而且中國近年來市場化的結果，個人自主與自利意識正在日漸增強，對於自由價值與維持社會穩定秩序價值二者之間仍在劇烈拉扯，法治需求與「依法治國」的落實，顯然應該比「維穩」來得重要許多。

Collaborative governance has become an important model in the public administration operations. This model constructs collaborative structures and processes across the boundaries of public agencies, levels of government, and/or the public, private and civic spheres in order to make a deliberate public policy decision and solve the complex public problems. Collaborative governance is different from the hierarchy of bureaucratic model. The article will explore the contexts and contents of collaborative governance as well as its application to the case of Central Comprehensive Governance Committee of Social Order in China. As a result, collaborative governance is suitable for dealing with complex and cross-boundary problems, but it is not a panacea at all. Some related topics about collaborative governance and efficiency and effectiveness are discussed further.
