摘要

近年來不斷有棒球好手受到國外球團的賞識，與國外的球隊簽約，向國外發展。但是許多學生球員與國外球團或與經紀人簽約後，都引起了不小的風波，因此本文首先針對美、日各國對於球員簽約的限制加以探討，接著探討運動經紀人所應扮演的角色與功能，最後針對國內學生球員簽約的個案加以探討。本研究認為美、日各國職業運動與業餘或學生運動之間，皆有明確的限制與規定，在保護學生球員發展的前提下，主管機關及主事者應該在職業與業餘之間、在學生運動與職業運動建立明確的界線，並確保商業行為排除在學生運動之外，如此學生運動才可以長久的發展。建議相關單位在對於球員出國打球與運動經紀人的管理上，特別是針對學生球員所衍生的相關問題，應該建立一套完善管理辦法，避免未來有更多的問題產生。

Recently, many talented baseball players join Major League Baseball (MLB) or Nippon Professional Baseball (NPB). But as players signed contract with sport agent or professional teams, it came many disputes. The main purpose of this study was to discuss the regulation about high school players signed contract with professional teams, and the role and function of sport agent who played a significant role in these cases. Finally, used the high school players as examples, discussed these players' situation in Taiwan. This study proposed that for the well development of these players, there should be a clear line between professional and amateur, and excluded the commercial behavior in students' sport. The government should set up related regulations to manage sports agent.
