摘要

資訊科技的蓬勃發展，使得網路的影響力，深入國人日常生活的各個層面，而不受時間與距離限制的網路交易，更已成爲許許多多民眾日常生活之重心。隨著網路使用者頻繁利用網路訂購商品或享受服務，網路交易衍生的相關法律議題也逐漸發酵，其中，網路交易過程中因「價格標示錯誤」產生的問題，更是備受關注與爭議。當購物網站發生價格誤標情事時，企業經營者與消費者爭執的重心，多在於雙方之間的買賣契約是否已有效成立，以及當契約有效成立時，消費者是否有權要求業者依約給付，抑或企業經營者得依民法規定撤銷其錯誤之意思表示，而使契約溯及失效。本文嘗試以臺北地方法院基於同一事實而作成的兩起民事判決爲中心，探討網路購物業者錯誤標示商品價格衍生的相關法律議題，以及實務見解可能存在之問題點。期透過本文之研究，助益各界對於此一數位時代產生的新興課題，能有更爲深入之認識。

Along with the development of internet and digital technology, traditional transaction activities are replacing by electronic commerce. In accordance with the data of Market Intelligence & Consulting Institute (MIC), Taiwanese online shopping B2C market reached a scale of NT $ 136.5 billions in 2008. At the same time, it become a controversial dispute when online shopping stores mistakenly marked the wrong price and the consumers did make an order. The problem over the price mislisting caused some legal issues: Is the electronic contract of the sale valid? Webpage which contains price and other selling information is an ”offer” or an ”invitation to offer”? Could the online shopping stores revoke its expression acting under a mistake? In this article, the article first introduce the facts and options of two important cases of Taipei District Court. On the basis of materials above, the author will further analyze the major issues related to Civil Law and Consumer Protection Law within the two cases. Finally, the author will try to provide some significant suggestions to the newest problem caused by price mislisting.
