芬蘭憲政改革對台灣憲改的啓示

摘要

台灣自1991年迄今，已推動多次修憲，達成民主鞏固的成果。今年(2005)更以民主深化為目標，推動立法機關選制改革與公投入憲等重大憲政變革。但台灣的憲政體制，在歷經多次修憲後，仍有不少的制度缺失未能一併解決，未來勢需再度運轉修憲工程。本文藉由芬蘭2000年憲政改革過程的經驗，探討其憲政制度變遷的緣由、變遷特色及其轉型竅門，並從中萃取值得經驗借鏡之處，作為台灣制度移植的參考，期能對台灣憲政改革有所貢獻。

The purpose of this paper is to draw lessons from Finnish constitutional reforms. Four parts are included in this paper. First, the background of Finnish constitutional reform is described. The second section explains the main changes of Finnish constitution. Third, this paper attempts to figure out the knack to reform constitution successfully. Then this paper discusses several institutions of Finnish constitutional system that Taiwan could learn from it. The author also mentions that prospective evaluation of the institution before transfer is need.
