從美軍軍人福利制度探討國軍退伍軍人福利制度

摘要

綜觀大環境的轉變，政治民主化、經濟發展、社會福利建構和擴張，國防法在2000年1月29日公布實行，其中第16條及第18條明確律定現役軍人的福利以法律定之、以法律保障。另為因應國軍兵役制度的轉變，如何藉由志願役人員福利制度的發展，考量軍教待遇遠勝於人民的負面心理，參照美軍軍人福利制度，訂定具體國軍適切可行的福利制度，藉以強化並提升整體國軍人力素質，打造堅實國防勁旅。為此，探討美軍軍人福利制度的執行情形，對照國軍志願役人員福利制度的進程，對國軍退伍人員福利制度法制化願景，提出相關具體建議，俾利國軍人員福利制度發展更臻完備，在未來國軍人力素質將不斷提升的前提下，符合時代潮流，因應各種新形態威脅與挑戰。

Taiwan's maturing democracy, rapid economic development, and the expansion of social welfare system, provided the background for the implementation of the National Defense Law, which has been commenced on Jan.29, 2000. According to articles 16 and 18, the welfare of the armed forces services personnel has been clearly defined and protected by law. In order to respond to the changes resulted from the transition to an all voluntary forces. The present study therefore uses the example of the American Military Service Welfare Institution as an example, to discuss the possible development of a similar system for the ROC military. We envisage that this development will provide a strong incentive and subsequently strengthen the quality of our military service personnel producing a strong and solid national defense team.For this reason, we compare and contrast the execution of the American Army Welfare Institute with our own, and more specifically, the challenges that lies ahead en route to develop a standardized and legislated welfare system for our military service.
