美軍地面作戰行動交戰規則研析
A Study on Rules of Engagement of U.S. Force Land Operations
摘要
各項軍事行動的發動，如何在進行中，有效管制武裝力量，目前大都以「交戰規則」作為最重要的規範之一。美軍交戰規則是以「任務完成及自我防衛」兩大概念為中心，即使在賦予危急任務時，也都不限制自我防衛的最後底線。而國際人道法學院交戰規則的地面軍事行動，須先要思考行動發生在自己的主權領土上及他國的主權政府管轄，且要符合法律依據，如「駐軍地位協定（SOFA）」、「備忘錄（MOU）」或其他國際條約等國際法。地面軍事行動是戰爭活動中，最直接面對敵我雙方交戰的場景，其所涉及法律議題，也最複雜，如武力使用的強度、自衛權的界線、武裝衝突附隨的損害等等，所以，國軍應該充分地學習國際交戰規則的運用，以及強化多國聯盟軍事行動的合作，期可增添「依法用兵」的建軍價值。

Rules of Engagement (ROE) is an important law, which can regulatory any military operation. U.S. forces rules of engagement focusing on ”mission complete” and ”self-defence”. Even if danger, that cannot limit the right of self-defense.Furthermore IIHL rules of engagement consider the distinctive feature of land operations is that they take place on sovereign territory, with or without the permission of the sovereign government. The legal considerations include Status of Forces Agreement (SOFA) and Memorandum of Understanding (MOU).Because of land operation must directly face the battling scenes, so the most complex legal issues, such as use force, self-defence, Collateral damage etc.ROC force should learn Rules of Engagement (ROE), and multinational operations of cooperation, which can add military values of the ”Use forces in accordance with the law”.
