監獄化程度與申訴制度關聯之研究

摘要

本硏究者希望藉由探討監獄管理中之方式、態度、申訴制度及申訴管道之關聯性，減少匿名申訴之發生，並由此探討匿名申訴之動機，以減少匿名申訴所造成之負面效應，減少戒護事故之發生。本硏究從現行申訴制度，了解國內監獄實務運作，探討監獄化及管理運作對受刑人採行匿名申訴之影響，並以問卷資料進行實證分析。統計結果顯示，監獄化程度對管教人員接受程度和申訴制度之認知有貪面影響，而管教人員接受程度和匿名申訴意向間也有負面影響，其中，管教人員接受程度具有完全中介效果。本硏究並針對監獄管理制度及未來硏究發展方向提出具體建議。

Analyzing survey data, the current study investigates the relationships between prison management, prison guards' attitudes toward grievance, and grievance system. It aims to reduce the negative effects of anonymous grievance. Moreover, inmates' motivations of utilizing anonymous grievance are also explored. The results show that prisonization has negative impacts on prison guards' acceptance and recognition of anonymous grievance.In addition, prison guards' receptiveness of grievance serves as an interverning variable between prisonization and anonymous grievance machinery. Implications for prison management and suggestions for future research are provided.
