宜蘭縣農舍建築執照審查作業之研究

摘要

宜蘭縣具好山好水之天然條件，伴隨雪山隧道之開通，都市人口加速湧入宜蘭縣郊區，購置農地興建農舍，造成宜蘭縣農舍建築執造申請案件，如雨後春筍般暴增不少。宜蘭縣現行農舍建築執造審查作業，因農地區位不同，負責核發建築執造之主管建築機關也不同，又因有些應檢具之證明文件，申請過程須呈接力式進行，導致申請時間太長，諸如此類議題，宜蘭縣現行農舍建築執造審查作業實有探討之必要。本研究首先檢視現行農舍建築執造審查之作業流程及應檢具容許證明文件之內容及特性，並選取11個農舍建築執造審查之案例（包括都市計劃內及外），瞭解其中各作業間之相互關係及審查作業所需之時程，本研究接著針對建築執造審查之承辦人員及其他專業人士，進行深度訪談及問卷調查，以獲取對現今農舍建築執造審查制度之看法及建議。經綜合整理各項研究成果後，本研究提出五點結論與建議，並提供宜蘭縣政府擬定新的宜蘭縣農舍建築執造審查作業流程之參考。

Yilan County is uniquely possessed of beautiful natural conditions such as green mountains and clear water. With the opening of Hsuehshan Tunnel, people living in urban area are surging into Yilan County and purchase farmlands for the construction of farmhouses. As a result, applications for building permits of farmhouses in Yilan County have been mushrooming in recent years. Following the current procedure for obtaining a building permit of a farmhouse, an applicant should go to different agencies according to the farmland location. In addition, because some required documents need to apply in a relay style, the entire process is cumbersome and time-consuming. Thus, it is worthy to re-examine the review procedure for obtaining a building permit of a farmhouse in Yilan County. In this study, we first examine the existing review process and analyze the required documents. Next, we review eleven cases to understand the interrelations of different tasks in the review procedure and to calculate the total duration it takes to obtain a permit. Then we conduct interviews and questionnaire to obtain opinions and suggestions on improving the review procedure. Finally, in accordance with the conclusions resulting from this study, we recommend a new review procedure. The results of this study will be an important resource, when governmental officials initiate a revision of the review procedure for the application of building permits of farmhouses in Yilan County.
