摘要

「歐盟生物科技發明的法律保護之指令」簡稱爲「歐頭生物科技專利指令」(Biopatent-Richtlinie)。歐盟生物科技專利指令的重要性是關於生物科技發明的智慧財產保護以及倫理議題，目前世界唯一詳細規定的成文法，並且它爲其他世界各國樹立起立法典範。故分析「歐盟生物科技專利指令」有其必要性。解析「歐盟生物科技專利指令」不僅有助於我國產業、官方、研究、學術機構的理解與提供另一國際面向的利益衡量或價值考量之借鏡模式。除此之外，該解析之成果可以直接成爲我國參與國際組織很重要的依據。
