物權之自由與限制-以台灣與美國之不動產法制為例

摘要


本文係以法律經濟分析爲主要分析方法,分別從法律概念以及實證等兩個部分來探討有關物權種類採自由或限制之理論。在實證部分,本文從國家公權力分配之觀點,分別比較台灣與美國兩地間有關不動產物權種類制度,從不同之法治層面來探討究竟何種制度較符合保障人民基本權之要求。而本文所達成之結論爲,從法律概念而言,假若國家無法提出合理之證明,即應採用限制人民自由最小例如物權種類自由之制度,以符合保障人民財產權之要求。而在實證觀點,在採民主優位之法治前提下,本文認爲由於目前有關財產權之變化相當迅速,因此立法者應將決定物權種類之裁量權限交付給司法機關。而若採保障人民基本權之質質法治前提下,在比較立法與司法兩機關不同功能性後,本文亦認爲應將決定物權種類之權限交由司法機關決定。

This paper is to discuss the policy of Numerus Clausus in Taiwan both from the standpoint of Case law and economic analysis of law. In order to dicide the most appropriate standard policy of Numerus Clausus, both the law makers and the court should take the benefit and cost analysis into consideration. Among the benefit and cost analysis, the most important consideration is how to decrease or eliminate the unnecessary transaction costs. In the end of this paper, we conclude that in Taiwan the social situation has been changing very fast, therefore the legislative power should vest the judicial power more discretion power in order to meet the need of fast changing society.
