不動產財產權就是與不動產有關的財產權,本文第二部分首先從不動產和財產權的概念出發,定義不動產財產權;第三部分說明不動產財產權自由的意旨,作爲全文探討的基礎;第四部分探討政府限制不動產財產權的法律基礎和合憲性的界線,以表明政府對私人不動產財產權的限制也受到憲法的限制;第五部分列舉法制上對於不動產財產權的限制內容,包括取得、使用、收益、處分和排除他人干涉的限制以及課稅,以明瞭限制的內容;第六部分闡述限制不動產財產權的功能與成本,作爲限制不動產財產權的考量依據;第七部分主張不動產財產權仍以自由爲原則,限制必須符合正當法律程序,以取得二者的平衡;第八部分總結全文,提出本文結論。
Real property rights are those rights concerning real property. Part two of this thesis firstly defines real property rights from the concepts of real property and property right. Part three ex plains the meanings of freedom of real property rights as the basis of the whole thesis. Part four explores the legal basis of governmental regulation of real property and the constitutional boundary. Part five exemplifies the contents of regulations of real property. Part six narrates the function and cost of regulations of real property. Part seven emphasizes that freedom is still the principle, and regulation shall follow due process of law. Part eight is the conclusion of this thesis.
