自從釋字第587號解釋理由書引用「聯合國兒童權利公約」保障非婚生子女之身分權及人格權以來,該公約與「兒童最佳利益原則」在我國法上的落實遂成為國學界與實務界關注的焦點。本文除摘要敘述既有之研究發現外,並嘗試引介一個新的研究方法:以跨國資訊網站作為研究比較法之主要根據地,並以英文作為合作研究日本法之中介語言。本文首先介紹公約中之「兒童\子女最佳利益」原則及其內國法化之概況,再檢視我國民法上之「子女最佳利益」在法律文字與司法解釋上之內涵,從而窺探公約對於我國親子法制之影響。另就日本相關法律資訊進行初步搜尋,並於本文第四部份分享法律資訊應用方法與初步搜尋結果。
Since the making of Judicial Interpretation No.587, in which the UN Convention on the Rights of the Child was quoted to demonstrate the importance of a child's rights to paternity and personality, the practice of the Convention with the principle of the best interests of children has become a focus of academic and judicial attention. Apart from summing up accumulated research findings on this issue, the article attempts to introduce a new research method based on a cross-national database using English as the media for exchange of legal information. It first introduces the principle and sees how it has been realised in Taiwan national laws, then goes not to review its contexts in the provisions of the Civil Code to detect the impacts of the Convention on Taiwan parent-child regulations. The other half of the article will first turn to investigate in English websites and databases how the Convention work in Japanese law, followed by a shared examination on found information.
