大學勞作教育和校外實習課程爭議之省思-從大學教育內涵與學生之受教權和勞動權保障說起

REFLECTION ON THE CONTROVERSY OF UNIVERSITY LABOR PROGRAM AND EXTRACURRICULAR INTERNSHIP PROGRAMS - STARTING FROM THE PERSPECTIVE OF THE CONTENT OF UNIVERSITY EDUCATION AND THE PROTECTION OF STUDENTS' EDUCATIONAL AND LABOR RIGHTS

摘要


雖然我國憲法保障學生在校的權利,但是許多大學仍不了解或是忽略法律對學生權利的保障。近年來因為大學涉及學生勞動力之課程爭議愈來愈多,大學生在學期間之權益是否受到保障,備受關注。因此,本文試著從大學教育的內涵與學生之受教權和勞動權的角度來檢視目前最受爭議的大學勞作教育和校外實習,並提出省思與討論。大學應該重新思考勞作教育的選課制度和實質的課程內容以滿足教育的意義,且不該侵犯學生之勞動權益。大學校外實習是幫助學生「學用合一」的重要課程,學校應盡力支持學生,並保護學生之受教權和勞動權益。儘管現行法令尚未完善,但是大學應該本於教育的使命和責任以保障學生的權利,發展和建立學校和師、生之間的信任關係,以彌平爭議,達成共好的教育目標。

In Taiwan, many university officials are still unaware of students' legal rights protections, or ignore them although the Constitution protects the rights of students at school. In recent years, there have been more and more controversial issues in college courses including on-the-job training. Whether the students' rights have been protected is a high concern. This article is trying to call upon the most controversial labor program and Extracurricular Internship from the perspectives of the meaning of university education and students' rights of education and labor. The labor program should have the course selection system and contents redesigned to fulfill the education purpose, and the students' labor rights should not be violated. The off-campus internship is a very important training course to help students' integration of work experience and learning. The schools should do their best to support the students and protect their rights in education and labor. Although the current legal protection is still insufficient, universities should base on the education mission and be responsible to protect students' rights. Developing and nurturing trusting relationships among students, teachers and the university should settle the disputes and achieve the common good educational goals.
