護理人員對權益了解及諮詢管理之探討

Nurses' Understanding of Their Rights and Channel for Consultation

摘要


目的:本文為探討台灣某一都會區護理人員對權益及諮詢管道之了解程度。方法:以半結構式問卷調查方式隨機抽樣4,500人,回收率58%,以有效問卷2,714份之資料加以分析。結果:在護理人員的工作投保方面,83.9%人員兩者(公/勞保、健保)皆有投保,有1.7%不清楚自身投保狀況。投保金額方面,28.1%投保金額小於實領薪資,而42.3%不清楚自己的投保薪資。48.9%人員有簽訂工作契約,完全清楚契約內容者佔53.1%、完全不清楚者佔3.6%,對工作契約不清楚的原因,包括雇主未給時間考慮和仔細閱讀為主要原因。契約不合理的原因,含工作契約條款只利於資方、工時超過勞基法規定、薪資過低、簽約書皆被資方收走、未依法排休、被安排從事非護理專業工作等等。有關自身權益受損時,解決的方式大都為默默接受或自行詢問他人,11.2%會向護理師護士公會諮詢,向醫院反應者只佔0.7%。結論:護理人員應瞭解勞資關係的內涵,參與爭取安全工作環境、合理薪資及工時,並共同維護勞資雙方的權益。另護理專業團體可協助護理人員查詢專業權益外,也應提供執行業務時相關之資源協助,藉以共同維護護理權益及保障。若整體醫療發展能重視及建構護理職場環境,可進而提供病人優質的醫療照護。

Objectives: This article explored nurses' understanding of their rights and resources for consultation in a metropolitan area in Taiwan. Methods: The study used a semi-structured questionnaire to a randomly selected group of 4,500 nurses and had a 58% response rate. Results: The analysis was based on 2,714 valid responses. 83.9% of the nurses had both civil/labor insurance and health insurance; 1.7% did not know their insurance status. 28.1% of the nurses considered their insurance amount to be below their actual wage level; 42.3% did not know their insured amount. 48.9% of the nurses signed a work contract; however, among those who had a contract, only 53.1% were fully aware of the contract contents and 3.6% were totally unaware. The main reason for not fully understanding was lack of time to read and understand during the contract signing. Issues related to the work contract included its favoritism to the employer, working hours exceeding the Labor Law, low wages, no copies of a signed contract given to employees, lack of planned break time according to Labor Law, and possible assignment to work non-professional nursing duties. Only 11.2% of the nurses would consult the Nurses' Association and 0.7% would report to the hospital management when their rights were infringed; most nurses chose to either be silent or consult peers. Conclusion: Nurses need to gain better understanding of labor relations, to demand a safe working environment, to have reasonable wages and working hours, to jointly safeguard the interests of both employees and employers, and to consult professional organizations and other resources regarding their rights and actions. Improvement in nursing structure and work environment will lead to better quality in patient care.
