台、美、英教師組織工會安全制度之比較研究:公共部門勞資關係之觀點

The Union Security System for Teachers Organizations in Taiwan, U. S. and U. K.: A Comparative Study from the View of Labor-Management Relation in Public Sector

摘要


公共教育部門勞資關係的法制化,不僅得以提昇學校組織效率,更可以建立良性夥伴關係,有利教育服務品質之提昇。但是我國教師法欠缺對教師組織運作保障的工會安全制度,相關法令對教師組織之協商運作及保障亦缺乏明確規範,導致行政部門與教師組織雙方在政策制定過程中衝突不斷,治理結構關係日漸惡化。因此,本研究嘗試運用系統性之概念架構,採取文獻分析及歷史比較等分析方法,透過公共部門勞資關係之觀點,針對我國與英、美等先進國家教師組織在工會安全制度之發展經驗,進行深入比較研究,以提供我國政府部門未來修正相關政策方案及法令之參考。

The legalization of labor relation in the public education sector promotes not only efficiency of school organization, but also creates positive partner relationship to improve the quality of education service. However there is no any ”union security” system in ”Teachers' Act” of Taiwan for positive development of labor relation in education sector that may cause the conflicts between teachers' organizations and the administration while the governance structure getting worse. Thereupon, this article tries to conduct a comparative study, by using the methods including document analysis, historical comparison from the view of labor-management relation in public sector, to aim at the experience and mechanism of the ”union security” system in Taiwan, U.S. and U.K. and wish to offer policy recommendations for government to revise the relative policy in future.
