This article analyzes the controversial issues of 2006 Kaohsiung City Mayoral election from ”election justice”, ”vote recount” to ”ballot amount incorrect”. These issues revealed an urgent request to promptly reform the electoral lawsuit system. In regard to the ”election justice”, the writer recommends adding slander crime as an element of electoral lawsuit for invalid winner. For ”vote recount”, he suggests revising Election and Recall Law to implement automatic judicial administrative recount mechanism. For ”ballot amount incorrect”, he recommends to clearly define the meaning of potential invalid votes and treating them as ”ballot amount incorrect” and statutorily invalid votes. Furthermore, he also suggests reviewing the difference between ”electoral lawsuit for invalid winner” and ”electoral lawsuit for invalid election”.
